Please read this carefully before using The Day Before or acting on any content published here or in the accompanying email.

1. Informational purposes only

The Day Before (the “Service,” “we,” “us,” or “our”) publishes probabilistic market forecasts, trade ideas, editorial commentary, calendars, quotes, and related data for general informational and educational purposes only. Nothing on this website, in our email newsletter, in our API, in our Model Context Protocol (MCP) endpoints, or in any other channel we operate constitutes:

  • investment, financial, legal, tax, or accounting advice;
  • a recommendation, endorsement, solicitation, or offer to buy, sell, or hold any security, derivative, digital asset, or other financial instrument;
  • a personalized recommendation of any strategy, allocation, position size, or account structure; or
  • an offer to provide brokerage, advisory, custody, or execution services of any kind.

We are not a registered investment adviser, broker-dealer, futures commission merchant, commodity trading advisor, bank, or any other regulated financial institution, and no content published by us should be construed as such. You should not treat any content on the Service as a substitute for individualized advice from a qualified, licensed professional who is familiar with your specific financial situation, objectives, and risk tolerance.

2. No fiduciary or advisory relationship

Your use of the Service does not create an advisory, fiduciary, brokerage, agency, employment, or professional relationship of any kind between you and The Day Before, its authors, its operators, its affiliates, or its contributors. We owe you no duty of care with respect to your investment decisions, and we do not know your identity, portfolio, tax status, jurisdiction, or objectives.

3. Forecasts, probabilities, and forward-looking statements

The Service publishes probabilistic estimates about future market behavior. These are opinions and modeled estimates, not predictions of fact. A probability is an expression of uncertainty; even a high-probability forecast will be wrong a material portion of the time. Forecasts, price targets, expected moves, trade ideas, catalysts, and any accompanying commentary are forward-looking statements that involve known and unknown risks, assumptions, and uncertainties. Actual results can, and often will, differ materially from anything expressed or implied on the Service.

Past accuracy is not a guarantee, indication, or reliable predictor of future accuracy. Any published track record, backtest, or performance metric may be incomplete, unaudited, subject to restatement, and computed using assumptions that would not be achievable in a live account (including but not limited to zero slippage, unlimited liquidity, and no fees, taxes, or borrow costs).

4. Trade ideas are not orders

“Trades to Consider,” sample entries, limit prices, stop levels, and take-profit targets are illustrative teaching examples intended to demonstrate how a disciplined trader might think about an idea. They are not orders, signals, or recommendations tailored to you. We do not know whether any given idea is suitable, permissible, tax-efficient, or economically viable for you, and we take no responsibility for outcomes if you choose to act on one.

5. Third-party data, quotes, and content

Quotes, fundamentals, earnings times, economic release schedules, company profiles, and related market data are obtained from third-party sources (including but not limited to Finnhub and publicly available issuer disclosures). We do not guarantee — and expressly disclaim any warranty regarding — the accuracy, completeness, timeliness, sequencing, or fitness for any purpose of any such data. Data may be delayed, stale, incorrect, missing, rounded, adjusted, or presented outside of regular trading hours. Do not rely on any figure shown here as an execution price.

Any links to third-party websites, brokers, research platforms, or products are provided for convenience only. We do not control, and are not responsible for, the content, policies, availability, accuracy, or practices of any third party.

6. AI-generated content

Portions of the Service — including headlines, editorials, trade rationales, and summaries — are generated in whole or in part by large language models. AI systems can produce content that is plausible-sounding but inaccurate, incomplete, out of date, or entirely fabricated (“hallucinated”), including with respect to tickers, prices, dates, catalysts, quotations, and named individuals or entities. You should independently verify any factual claim before relying on it. The Day Before does not warrant that AI-generated content is free from such errors.

7. Risk disclosure

Trading and investing in securities, options, futures, foreign exchange, digital assets, and other financial instruments involves substantial risk of loss, including the loss of principal, and is not suitable for every investor. Leveraged and derivative instruments can produce losses that exceed the amount originally invested. Short selling exposes you to potentially unlimited losses. Market conditions can change rapidly and without warning; liquidity, borrow availability, and execution quality are not guaranteed.

You are solely responsible for evaluating the merits and risks associated with any decision you make and for any resulting outcome. Only risk capital — money you can afford to lose without impacting your financial well-being — should be used for trading or speculation.

8. Advertising, sponsors, and affiliate links

The Service may display sponsor slots and outbound links, some of which are affiliate links. If you click through and open an account, subscribe, or make a purchase, we may receive a referral fee at no additional cost to you. Sponsor and affiliate arrangements do not influence our editorial, forecasts, or trade ideas. See our advertising & affiliate disclosures for details.

9. No warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, timeliness, reliability, availability, or that the Service will be uninterrupted or error-free. To the maximum extent permitted by applicable law, we disclaim all such warranties.

10. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall The Day Before, its owners, operators, authors, contributors, affiliates, licensors, or data providers be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, trading gains, goodwill, or other intangible losses, arising out of or in connection with (a) your use of, or inability to use, the Service; (b) any content on the Service, including any errors, omissions, or inaccuracies; (c) any transaction or decision made in reliance on the Service; or (d) unauthorized access to or alteration of your transmissions or data — whether based in contract, tort (including negligence), strict liability, or any other legal theory, and regardless of whether we have been advised of the possibility of such damages.

11. Jurisdiction and eligibility

The Service is operated from the United States and is directed to audiences in jurisdictions where its content and materials may lawfully be accessed. Nothing on the Service is intended for any person in any jurisdiction where the publication or availability of the Service would be contrary to local law or regulation. It is your responsibility to determine whether your use of the Service is permitted where you are located and to comply with all applicable laws.

12. Changes to this disclaimer

We may update this disclaimer at any time by posting a revised version on this page. Changes are effective immediately upon posting. Your continued use of the Service following any change constitutes your acceptance of the revised terms.
